Can an epidural cause chronic back pain?

I had a botched epidural with my recent delivery. The doctor continued to stab the needle in and out with no success, she never felt my back at all, just stabbed at me with the needle. It was agonizing and only furthered my discomfort. It's been 5 weeks and I'm suffering from acute pain in the lower and upper areas of my back. My migraines have come back full strength as well. Can this be caused by the epidural and if so what is the hospitals liability?
